AutoPartsWAY Plus Membership Terms and Conditions
These AutoPartsWAY Plus Membership Terms and Conditions (“Terms”) govern your participation in AutoPartsWAY Plus Membership (the “Program”). The Program benefits are issued and administered by AutoPartsWAY (“AutoPartsWAY”, “we”, “us” and “our”). By enrolling in the Program, you agree to comply with these Terms. These Terms are subject to AutoPartsWAY’s Terms of Use and Privacy Policy, which are incorporated herein.
All benefits offered under the Program are at our sole discretion. We reserve the right to limit, modify, alter, waive, or cancel the Program and/or benefits offered under the Program at any time, prospectively or retroactively, with or without notice.
MEMBERSHIP TYPE
AutoPartsWAY offers one Plus membership subscription: an annual AutoPartsWAY Plus Membership. The benefits of the AutoPartsWAY Plus membership are described below.
AutoPartsWAY Plus Benefits
- Free Ground shipping on eligible orders over $100 shipped from the same fulfillment center.
- Access to AutoPartsWAY’s exclusive AutoPartsWAY Plus sales and shopping events.
- Priority Customer Care phone support for AutoPartsWAY Plus members for non-escalated cases.
- Priority email support for AutoPartsWAY Plus members.
- 60 Day return policy on eligible purchases.
- Priority warehouse order processing before non-member orders whenever possible.
- 1 year refund coverage on eligible warranty returns.
CONDITIONS
- You must be 18 years of age or older to obtain a Membership.
- Your participation in the Program is revocable by us at any time, at our sole discretion.
- You may have only one Membership per email account.
- Except as otherwise outlined in these Terms, for any benefit to apply, your Membership must be active at the time of purchase.
- Your Membership is non-transferable.
FEE
The AutoPartsWAY Plus Membership fee is $29.99 for one year. We may change the AutoPartsWAY Plus Membership fee or run special promotions at any time, but changes will apply only to new or renewed memberships. The AutoPartsWAY Plus Membership fee is non-refundable, except as set forth herein.
TERM
The initial term of your AutoPartsWAY Plus Membership begins on the date it is purchased and continues for one year unless terminated earlier under these Terms. AutoPartsWAY Plus is offered as an annual membership subscription. Renewal and billing handling, where applicable, may be processed using a payment method on file unless you cancel before renewal by contacting Customer Service.
PAYMENT
Unless waived as part of a promotion, the AutoPartsWAY Plus Membership fee will be billed to an available payment method associated with your AutoPartsWAY order or account.
MEMBERSHIP CANCELLATION
You may cancel your Membership at any time. No refunds will be given except as required by law or if we materially change the Program. You can request cancellation by phone, e-mail, or live online chat.
DISCLAIMERS; LIMITATION OF LIABILITY
THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. AUTOPARTSWAY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES (“PROVIDERS”) DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT IN ANY WAY RELATED TO THE PROGRAM. PROVIDERS MAKE NO WARRANTY THAT THE (i) PROGRAM WILL MEET YOUR REQUIREMENTS, OR (ii) PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. IN NO EVENT WILL PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO THE PROGRAM, INCLUDING BUT NOT LIMITED TO YOUR USE OR INABILITY TO USE THE PROGRAM OR UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR MEMBERSHIP DATA. NOTWITHSTANDING ANYTHING TO THE CONTRARY, PROVIDERS’ TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WILL NOT EXCEED THE LAST ANNUAL MEMBERSHIP FEE YOU PAID.
GOVERNING LAW
These Terms, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without regard to conflict of law principles.
BINDING ARBITRATION
Any controversy or claim arising out of or relating to these Terms (including any breach thereof) or the Program shall be settled by confidential arbitration. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated with any claim or controversy of any other party. The foregoing shall not preclude AutoPartsWAY from seeking any injunctive relief.
CHANGES TO AUTOPARTSWAY PLUS
We may make changes to any or all benefits available to you under the Program at any time, with or without notice. In the event of any material change to the Program, we may, in our sole discretion, either maintain your Membership with your existing benefits until expiration of your current term or provide an appropriate pro-rata remedy as required by applicable law.
AutoPartsWAY Plus Trial
AutoPartsWAY sometimes offers customers free trial or other promotional memberships. Such memberships are subject to these Terms and Conditions except as otherwise stated in the promotional offers. Trial memberships will be converted automatically to paid memberships at the end of the trial period and members will be charged the full membership price at that time. Trial memberships may be cancelled before the end of the trial period by contacting Customer Service.
